Acceptance of Terms and Conditions
1. Useful information
- Flowing is the trading name of Flow.ing Escola de Idiomas e Gastronomia LTDA, Registration number (CNPJ) 36.280.152/0001-32 and is referred to as Flowing in this document.
- ‘Course’ is the period of study paid for from the first to the final day of the booking received from the student or his/her representative.
- ‘Student/ User’ is used here and throughout these Terms and Conditions to refer to any individual who has paid to undertake an online course at Flow.ing.
- Digital Platform or Platform: is referred to the website made available by Flow.ing, that acts as an intermediary for English school services via the internet, which is used to provide the content of the lesson, as well as exercises and auxiliary materials related to the subjects taught.
- ‘Contract’ is the agreement between Flow.ing and the Client (student or user) to provide a course and ancillary services.
1.1 These terms and conditions constitute a legal agreement between you and Flow.ing with respect to the use of the Website and shall be legally binding in all circumstances. By using any Service provided by Flow.ing, you agree to accept them fully. By buying a Course, you will be deemed to have confirmed your acceptance of these Terms and Conditions. These terms and conditions may be changed at Flow.ing’s discretion at any time and it is the responsibility of each User to ensure that he is fully aware of the current terms and conditions at all times. Continued use of the Website or continuing to deal in any way with Flow.ing will be deemed to constitute acceptance of any variation of the terms and conditions.
1.2 When registering, you will be required to provide and verify personal information about yourself. You must keep these details accurate and up-to-date. By registering an account you are confirming that you are over 18 (eighteen) years of age and that you accept these terms and conditions. Persons under eighteen years of age are required to register through a User who is over eighteen and that adult person shall be solely responsible for ensuring that only appropriate content is passed on to the minor under eighteen.
2. General
2.1 The User must keep his information (email and address) properly updated in case any notifications are sent by Flow.ing. The responsibility rests entirely on the user if the notification wasn’t received at an updated address.
2.2 The User declares and acknowledges that he has fully understood all the clauses and conditions agreed in these Terms and Conditions and is obliged to comply with them faithfully in accordance with the principles of good faith and loyalty.
2.3 All courses are subject to availability.
2.4 The minimum age for enrolment on an adult course is 16 years.
2.5 Students under 18 may study but all courses must be registered and bought by a User over 18.
2.6 Flow.ing reserves the right to cancel, change or combine classes if circumstances require this. In such cases Flow.ing would offer alternative arrangements but no refund or credit would be given in these circumstances.
2.7 Our courses are ongoing and start every Monday. Private tuition courses can start any day at your convenience. For closed courses please refer to the start date on the course page. We are closed during the Christmas period.
3. Payment and Billing Policies
3.1 All fees are payable in REAL(R$), with the amount corresponding to the dollar indicated on the course page and will be executed by PayPal, at the time of finalizing the purchase of Flow.ing services
3.2 Any fees charged by your credit card provider in connection with your purchase of Services or other fees associated with connecting to the Internet are for your own account and Flow.ing shall not be responsible for these.
3.3 Payments can be made by debit or credit card.
3.4 Flow.ing guarantees that every credit card transaction you make on flowingbv.com is 100% secure.
3.5 Included in course fees: placement test, tuition, materials, end-of-course certificate.
4. Holidays and Sickness
4.1 We are open all year round except during the Christmas period.
4.2 Holidays may not be taken during fixed courses such as Business English etc.
4.3 Holidays can only be taken in week blocks (Monday to Friday) and not in individual days.
4.4 Holidays must be booked at least two weeks in advance.Fees will not be refunded for holidays taken without notice in advance.
4.5 If you are unable to attend classes because of short-term illness, you will not be compensated for any classes missed.
4.6 If you are unable to attend classes because of long-term illness, you should obtain a medical certificate and at management discretion your course can be postponed from the date when the medical certificate is seen but not refunded.
5. Course changes
5.1 Course modality cannot be changed, for example, from an ongoing course to fixed course or one-to-one.
6. Attendance
6.1 Students are expected to attend classes regularly and on time. Students may lose their place on a course if they are frequently late, absent or leave before the end of their course.
6.2 There is a 15-minute tolerance period to join a class, if a student arrives late, he will not be able to join the class and he will be charged the full fee for the class.
6.3 In order to receive a certificate, students must attend a minimum of 80% of classes scheduled.
7. Course Cancellations and Refund Policy
7.1 We do not offer refunds of purchases or services and do not return funds after payments have been made. All sales and purchases are final.
7.2 If you cancel your course after the start date or decide to leave early, there is no refund under any circumstances.
7.3 Tuition fees are non-refundable in the case of late or no-show students.
7.4 In Group courses, if you miss a lesson, regardless of the reason, we cannot give a refund or allow you to take the lesson at another time.
7.5 You must give 24 hours’ notice on a weekday to cancel a private tuition class or you will be charged the full fee for the lesson. To cancel a block booking of one-to-one lessons, one week’s notice must be given, and classes will be rescheduled.
7.6 Cancellations through serious illness, death of a close family member or other circumstances will be evaluated at the discretion of the management.
7.7 In the event of being unable to supply services to which it is contractually bound resulting from a Force Majeure i.e. causes out of our control, such as, but not limited to, natural disasters, labour disputes, government action, etc. refunds will not be made.
8 Passwords
8.1 To use certain features of the Website, you will need a username and password, which you will receive through the Website’s registration process. You are responsible for maintaining the confidentiality of the password and account and are responsible for all activities (whether by you or by others) that occur under your password or account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security, and to ensure that you exit from your account at the end of each session. We cannot and will not be liable for any loss or damage arising from your failure to protect your password or account information.
8.2 The user has the sole responsibility to update and maintain the information provided during the registration process on the Platform.
8.3 Flow.ing is not responsible for incorrect or untrue information provided by the User, when registering, and for any damages caused to third parties and the User because of false information provided.
8.4 The User acknowledges that, if the information provided during the registration process is incorrect or untrue, his access to the Platform may be suspended, regardless of any formality, until the necessary changes are made.
9. Use of the Service
9.1 An account is personal to a User and is not transferable. Each User will be held responsible for all actions committed with the use of his username and password and must take all measures necessary to protect his security and not divulge it to any person.
9.2 Each Flow.ing account is limited to 1 user, meaning only the paying member can use the account. If more than one person is using the same account to attend lessons, this is a violation of this service agreement and the account will be permanently banned.
9.3 In our sole and absolute discretion, we may terminate your Account, or modify, reclaim or remove any username associated with your Account, for any reason (including for reasons related to unlawful or unauthorized usage) and we are under no obligation to retain a record of your Account or any data or information that you may have stored by means of the Account and/or the Services.
9.4 Flow.ing reserves the right to suspend the operation of the Website at any time for maintenance and improvement or for such other purposes as it may deem necessary. Flow.ing is not responsible for any loss resulting from your using any of Flow.ing’s services, software, materials, audio or video files, content, or communications.
10. Intellectual Property Rights and Data Protection

11.Changes to these Terms
Flow.ing reserves the right, at its sole discretion, to modify or replace these terms at any time. It is your responsibility to check these terms periodically for changes. Your continued use of the site following notice of the Agreement modification will be considered an acceptance of the modified terms and conditions of use. Furthermore, Flow.ing reserves the right to modify, suspend or discontinue the Website at any time.
12. Legislation
These Terms and Conditions will be governed, interpreted and executed in accordance with the laws of the Federative Republic of Brazil, regardless of the conflicts between these laws and the laws of other states or countries, with jurisdiction and election of the District Court of Curitiba / PR to resolve any queries. The User consents to the competence of this judgment and renounce the competence of any other forum, however privileged it may or might be.
